These Terms of Use ("Terms") govern your use of ObituaryAI (the "Service"), provided by Heavenly Farewells ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

ObituaryAI is a writing support tool that helps families and funeral professionals draft obituaries, eulogies, programs, and related memorial content using AI. ObituaryAI does not provide legal, medical, funeral directing, or publishing services. You are responsible for reviewing all generated content for accuracy before use.

2. Eligibility and accounts

You must be at least 16 years old (or the age of majority in your jurisdiction) and, if you are accepting these Terms on behalf of an organisation, you must have authority to bind that organisation. Keep your login credentials confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date.

3. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • use the Service for any unlawful, fraudulent, or deceptive purpose;
  • upload content that infringes intellectual property, privacy, or other rights of third parties;
  • send spam, malware, or attempt to compromise the Service;
  • probe, scan, scrape, or interfere with the security or integrity of the Service;
  • attempt to reverse engineer, resell, or redistribute the Service or circumvent technical limits;
  • use the Service to generate hateful, harassing, defamatory, or otherwise harmful content.

4. Your content

You retain ownership of the content you submit. You grant us a limited, non-exclusive license to host, store, and process your content solely to provide the Service to you. You are responsible for the accuracy of generated drafts and for verifying facts before publishing or printing.

5. AI-generated content

Drafts produced by the Service may be inaccurate, incomplete, or contain errors. They are not a substitute for professional advice. Do not use outputs in regulated or professional contexts without independent review. You are responsible for your prompts, the use of outputs, and for having the rights to any input content you provide.

6. Intellectual property

We retain all rights, title, and interest in the Service, including the software, documentation, and Heavenly Farewells / ObituaryAI branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

7. Payments, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for the refund window and how to request a refund. Subscription plans renew automatically until cancelled; you can cancel at any time through the customer portal and retain access until the end of the current billing period.

8. Service level and warranties

The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (such as for fraud, death, or personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your unlawful use of the Service, or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, you may export your drafts within 30 days, after which we may delete data we are not required to retain.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Heavenly Farewells is established, without regard to conflict of law rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection laws provide otherwise.
